Here’s how to apply for subletting your MIDC plot in Maharashtra:
1. Understand the Eligibility:
- You must be the original allottee of the plot with a valid lease agreement.
- The plot should have completed the minimum FSI and obtained the B.C.C. as per MIDC norms.
- Subletting is permitted for the same activity only (e.g., industrial to industrial, commercial to commercial).
- Subletting term can be up to 10 years with prior MIDC approval.
2. Prepare Documents:
- Request letter to MIDC: Clearly state your intent to sublet, plot details, and proposed sub-lease period.
- MIDC online application form: Filled and submitted on the Single Window Clearance portal.
- Board resolution (Pvt. Ltd./Ltd. Co.): Authorizing subletting for companies.
- MOA & AOA (Pvt. Ltd./Ltd. Co.) or Partnership Deed: Proof of company structure.
- Building Completion Certificate: For constructed structures.
- Detailed Project Report (DPR): If activity change is involved.
- Copy of Final Lease Agreement: Proof of your plot ownership.
- Proposed Sub-Letting Plan: Layout and details of the sub-letted area.
- Up-to-date paid Water and electricity bills: Evidence of utility payments.
- Up-to-date paid Lease Rent Receipt: Proof of rent paid to MIDC.
- NOC from Financial Institution (if applicable): If a loan exists on the plot.
3. Submit Application:
- Submit the complete document set online through the Single Window Clearance portal.
- Pay the subletting fee in advance for the entire sub-lease period.
- The fee is calculated as: Subletting Fee = Area Subletted x Subletting Rate
- Subletting rate depends on activity (industrial/commercial/IT & ITES) and is typically 3% or 1% of MIDC land rate.
4. Await MIDC Approval:
- MIDC will review your application and documents.
- They may request additional information or clarification if needed.
- Expect the approval process to take around one month.
5. Obtain NOC & Register Sublease Agreement:
- Once approved, receive a No Objection Certificate (NOC) from MIDC.
- Register the sublease agreement with MIDC for legal validity.
