MIDC property due diligence check point before buying any industrial property.

1. Agreement to Lease of Plot: This document outlines the terms and conditions of your lease agreement with MIDC, including:

  • Plot size and location details
  • Lease period and renewal options
  • Permitted use of the land
  • Rent and other charges
  • Obligations of both parties

2. No Objection Certificate (NOC): Obtain NOCs from relevant authorities like:

  • MIDC itself, confirming no outstanding dues or disputes on the plot.
  • Local Municipal Corporation, property tax, regarding any zoning restrictions or clearances.
  • Pollution Control Board, for environmental compliance.
  • Any other relevant authorities based on the specific nature of your intended use.

3. Shareholding Structure Documents: If the buyer is a company, review its:

  • Memorandum and Articles of Association.
  • Shareholding pattern and board of directors’ details.
  • Any relevant resolutions or approvals for the land purchase.

4. Encumbrance Certificate: This document confirms the absence of any legal claims or encumbrances on the property, such as mortgages, liens, or disputes.

5. Land Record Documents: Obtain official copies of the land records, including:

  • Title deed
  • Property tax receipts
  • Midc transfer order
  • Building Completion Certificate (BCC)
  • Property chain documents

6. Transfer Deed / Sublease Deed / Deed of Assignment: Once the agreement is finalized, a transfer deed will be drafted and executed by both parties, transferring ownership of the plot to the buyer.
