Penalties for non-compliance with BCC?
Penalties for Not Complying with Building Completion Certificate (BCC)
BCC requirements under MIDC rules include several regulations and penalties.
1. Non-Utilisation Charges
If you don’t get a revised BCC showing at least 40% construction within 2 years from the circular date (e.g., by 21 June 2019):
In that case, need to pay a penalty of 10% of the current MIDC land rate for the part of the plot not used. This penalty is charged monthly until you obtain the revised BCC.
2. No Further Extension
After the 2 years, if you still haven’t met the 40% BCC requirement:
No more extensions will be granted.
MIDC may start the process to reclaim the unused part of your plot.
3. Delay Charges
You may face additional yearly penalties for:
Delays in starting production.
Delays in completing your construction and getting the BCC.
4. Risk of Plot Repossession
If you don’t meet compliance even after penalties and extensions:
MIDC has the right to take back any remaining undeveloped land, leaving only the area that has a valid Floor Space Index (FSI) with you.
